Italy’s New Protections for Workers with Serious Illnesses: What Law 106/2025 Means for 2026

Italy has introduced a landmark reform to safeguard workers facing serious health challenges. Law No. 106, approved on 18 July 2025 and published in the Gazzetta Ufficiale, became effective in August 2025 and will be fully operational from January 2026. This legislation aims to strengthen job security and flexibility for employees and self-employed individuals dealing with chronic or disabling illnesses, as well as parents caring for seriously ill minors.

Extended Job-Retention Leave

One of the most significant provisions is extended job-retention leave. Workers diagnosed with cancer or chronic illnesses resulting in at least 74% disability can now request up to 24 months of unpaid leave after exhausting standard sick leave entitlements. This leave can be taken continuously or in segments, giving employees flexibility to manage long-term treatment plans. During this period, the employment relationship remains intact, although salary and benefits are suspended. Employees can also make voluntary pension contributions to avoid gaps in coverage.

Paid Hours for Medical Care

Starting in 2026, employees will have access to 10 hours of paid leave per year for medical appointments, diagnostic tests and treatments. This benefit also applies to parents of minors with serious health conditions. Employers will advance these hours and recover the cost through social security adjustments, ensuring minimal administrative burden.

Priority for Remote Work

To support reintegration after illness, the law grants priority access to remote work for employees returning from extended leave, provided their role is compatible with smart working. This measure helps workers transition back into employment while accommodating ongoing health needs.

Support for Self-Employed Workers

Self-employed professionals also benefit from the reform. They can now suspend their business activity for up to 300 days per year, doubling the previous limit of 150 days under Law 81/2017. Funding and Implementation

The government has allocated €20.9 million for 2026 to fund these measures, with gradual increases planned over the next decade. Eligibility certification will be managed through Italy’s electronic health data system (Sistema Tessera Sanitaria), reducing paperwork and speeding up processes.
