Our employer of record (EOR) services supports your expansion into one of the most competitive markets in Asia

With a culture based on successful service industries, a multi-national make up and cutting-edge technology it is perhaps no wonder that Malaysia has become one of Asia's fastest developing countries. This, combined with its status as a leading exporter of gas, electronics, automotive parts and a global player in technology, financial sectors and SAAs, are what have made Malaysia a key location for expanding businesses.

While Malaysia's diverse business landscape may be attractive for growing businesses, the 1955 Malaysian Employment Act contains numerous regulations that international businesses must comply with, including:

  • Employees must not work over 48 hours a week.
  • Any overtime must be paid at 1.5 times the base salary
  • Employment contracts must include a job description, compensation details, termination requirements and severance pay. An employment contract must also be written in both English and Malay.
  • Employees should receive 13th-month pay and discretionary bonuses
  • Employers cannot restrict an employee's right to join unions
  • Both employees and employers must contribute to the Social Security Organization and the Employees Provident Fund. This provides disability, retirement, medical payments, and survivors’ benefits. Contributions vary depending on employee age.
  • Annual leave, sick leave and maternity leave can vary depending on the length of employment.

As well as the above employment regulations, all foreign employees must obtain a valid work visa or pass before they begin work in Malaysia, a process made all the more complex due to different visas being issued for different skills and job types.

Meanwhile, businesses must establish a subsidiary in order to conduct business in Malaysia, a process that is complex and costly as well as extending your time to market. As your employer of record, we navigate Malaysian employment laws and visa requirements on your behalf. Therefore, you can focus on reaping the benefits of Malaysia's growing business markets without the complexities of a legal entity.

What is an Employer of Record?

Sometimes known as a PEO, an employer of record manages the employment of your international hires taking the legal responsibility of employee management and HR from your shoulders when you are hiring in Malaysia. While you are responsible for the day-to-day management of your employee, an EOR will:

  • Facilitate employment contracts
  • Comply with Malaysian employment laws
  • Pay taxes
  • Run payroll
  • Organise employee benefits

In addition to the above, an employer of record ensures that you can expand into Malaysia without a legal entity and with the knowledge that you comply with the Malaysian Employment Act.

Why do I need an Employer of Record in Malaysia?

Expanding internationally brings new labour laws that are individual to that country, in this case Malaysia. Navigating such legislation on top of growing your business can take up ample resources, budget and staff. In addition, acquiring a legal entity can be a lengthy, complex route that significantly extends your time to market. Applying for a legal entity and getting to grips with employment laws can also cause non-compliance. This is where our Employer of Record services come in.

With extensive experience and knowledge on Malaysian employment laws, an EOR can save you time, money and resources when it comes to expanding your business. Therefore, you can reap the benefits of one of Asia's fastest growing markets without the stress and liability of employment laws.
