Under Spanish employment law, contracts are generally presumed to be indefinite, with fixed-term contracts allowed only in specific circumstances. It’s vital that employers ensure contracts reflect the correct employment relationship and comply with legal requirements.

A standard working week in Spain is 40 hours, though it is expected that legislation will soon reduce that to 37.5 hours, calculated as an annual average, with limits on daily working time. Employees are entitled to rest breaks, weekly rest periods and a minimum of 30 calendar days of paid annual leave.
Employers are also required to maintain accurate records of working time, often referred to as time tracking (registro de jornada), to demonstrate compliance with working time regulations.
