Employee rights in Brazil
To fulfil Brazilian HR obligations, you must ensure the terms of your employment provide workers with the rights they are entitled to. This includes rights under legislation for employment, payroll and health & safety:
- Brazilian Employment Contracts: Although a written employment contract is not a legal requirement in Brazil, it is often common practice to provide one. According to the Consolidação das Leis do Trabalho (the Consolidation of Labour Laws), Brazilian employment contracts should include:
- Employer and employee details
- Salary (including mandatory 13th-month salaries), benefits & pension fund
- Contract start date (and expiry date, e.g. for fixed-term contracts)
- Working hours, leave schemes & termination agreements
- Location of work
- Probation period
- Employee duties (e.g. non-disclosure agreements)
- Company policies & practices (e.g. use of equipment)
- Conditions for travel/relocation for business purposes
- Compensation duties for employer damages
- Brazilian Payroll: Your Brazilian employees must receive either a physical or electronic copy (via eSocial) of their payslip monthly, which should show a full breakdown of all deductions. Common deductions can include:
- Statutory deductions such as tax and social security
- Any money owed by the employee, e.g. loans, scholarships or advancements
- Deductions authorised by the employee, such as life/health insurance and/or pension contributions
- The equivalent of any losses or damages incurred to the employer’s property caused by misconduct, negligence or lack of expertise on the employee’s behalf
- Health & Safety in Brazilian Workplaces: Brazilian employers are responsible for their employees’ health and safety at work. Hence, under Ministério do Trabalho e Emprego (Ministry of Labour and Employment) rules, measures must be in place to prevent job-related accidents and training must be provided to guide employees on how to perform their role safely.
Employee protections in Brazil
Employee protections are also a major part of Brazilian HR obligations, including protection against:
- Discrimination: Employers cannot discriminate against employees (e.g. based on gender, race, disability, age, etc.) at any stage of employment.
- Unfair Dismissal: Employers may dismiss employees without cause, but only if they respect the notice period outlined in their employment contract, and provide the severance pay. However, to do this they would need to pay a 40% penalty of FGTS (Fundo de Garantia do Tempo de Serviço, or Length-of-Service Guarantee Fund).
- Business Transfers: A period of continued employment does not create any statutory rights for employees, but in the case of a business transfer, they would retain their period of continuous work (which would apply to holiday rights, notice period and FGTS entitlement). This transfer can include a merge and acquisition transaction between companies within the same economic groups, or as part of an asset purchase.
- Data Breaches: Lei Geral de Proteção de Dados Pessoais (General Personal Data Protection Law) applies to any organisation that processes personal data. The law outlines the rights employees have:
- The right to access to the data & confirmation it is actually processed
- The right to correct inaccurate data
- The right to anonymise, block or delete unnecessary data or data that is not being processed in line with data protection rules
- The right to the portability of data to another service or product provider
- The right to information about public and private entities with which the controller has shared data
- The right to information about the possibility of denying consent and the consequences of such denial
- The right to revoke consent
Job security in Brazil
Optional trade union memberships are available to Brazilian employees, which often include Collective Bargaining Agreements (CBAs) that provide workers with better benefits. Employees are entitled to select whichever trade unions they prefer and employers cannot refuse or treat an employee differently because of their union membership status.

Are 13th-month salaries required in Brazil?
Yes, 13th-month salaries (Décimo terceiro salário) are a legal requirement in Brazil under the Consolidation of Labour Laws. This is equal to one month’s salary and is paid in two parts, one in November (without deductions) and the other in December (with INSS – Instituto Nacional do Seguro Social contributions and income tax deducted).
Which employee benefits are commonly provided by Brazilian employers?
- Medical Insurance: Commonly provided to Brazilian employees and their families (i.e. their spouse and any children in education up to the age of 24). However, employees are usually expected to contribute significantly to family premiums and the level of cover depends on the worker’s seniority at your company.
- Life Insurance: Almost always provided, including family funeral cover and accidental death (usually 24 months’ salary) or disability cover.
- Pensions: Most employers will offer supplementary pensions which provide benefits on a defined contribution basis.
