What does a Romanian employment contract include?
In Romania, employment contracts must include the following information:
- The identity of the parties, i.e. the employer and employee.
- The place of work – if this is not a singular/fixed location, details of how the employer will ensure transportation for the employee to and from the different locations where their work will be performed must be provided.
- The headquarters or domicile of the employer.
- The position/occupation in accordance with the Romanian Classification of Occupations or other regulatory job documents, as well as the job description.
- The professional activity evaluation criteria applied by the employer and any job-specific risks.
- The employment start date and the contract expiration date (in the case of a limited-duration or temporary employment).
- The annual entitlement to paid holiday leave.
- The length and conditions of the notice and probationary periods (including dismissal and resignation processes).
- The remuneration and its components, i.e. bonuses, the method of payment and the payment frequency.
- Working hours, expressed in hours per day and hours per week. This should also include the conditions under which overtime must be compensated.
- Reference to the collective governing agreement.
- The procedure of usage of the electronic signature.
- The rights and conditions under which professional training is provided to the employee.
- Other non-mandatory benefits, e.g. medical insurance, private pension contributions, etc.
What types of employment contracts are there in Romania?
Romanian employment contracts can be fixed-term up to a maximum of 36 months (which can be renewed twice) or indefinite/open-ended. Both types of employment contracts are usually governed by a Collective Bargaining Agreement (regulated by Law 367/2022).
The Collective Bargaining Agreement outlines the terms of employment and the employee’s rights. These will often cover a range of conditions, including wages, working hours and employee benefits.
According to the Romanian Labour Code (Law no. 53/2003), all employment contracts must be concluded in writing, in the Romanian language and on the basis of both parties’ consent (employer and employee).
Can I change an employment contract?
Yes, you can change a Romanian employment contract, as long as both the employer and employee have mutually agreed on the change. This is usually documented in a written addendum or amendment to the original contract.
Additionally, unilateral changes by the employer are limited to specific circumstances outlined in the Romanian Labour Code.
