Italian Employment Contracts: Advice & Guidance
Types of Italian Employment Contracts
There are two main types of work contracts in Italy – subordinate and parasubordinate. Subordinate employment is the classic employer and employee dynamic. Whereas parasubordinate regulates more hybrid conditions, where there is an ongoing collaboration instead of a ‘subordinate’ employer and employee set-up.
The specific types include:
- Open-Ended: A contract that mandates indefinite employment with no specific end date, whereby the employee can only be fired for “just cause”.
- Fixed-Term: A contract with a predetermined duration which can last a maximum of 2 years, after which it can automatically change to a permanent contract. Further fixed term contracts can only be issued in exceptional cases subject to the collective agreements, or in the case of seasonal work.
- Part-Time: Part-time contracts can mandate:
- Vertical Part-Time Employment: The employee works full-time hours (8 hours per day) but only on certain days of the week.
- Horizontal Part-Time Employment: The employee works every day but for fewer hours (e.g. only mornings or afternoons).
- Mixed: A combination of the two.
- On Call: On call contracts govern intermittent work, which is only completed at the employer’s need.
- Occasional Service: For ad-hoc, short-term and non-continuous work, occasional service contracts are used (the annual earnings limit is €5,000). This type of contract is commonly used by self-employed people at the beginning of their career as a way to start projects for their first clients before opening VAT numbers.
National Collective Bargaining Agreements (Contratto Collettivo Nazionale di Lavoro, CCNL) in Italy
In Italy, National Collective Bargaining Agreements are industry-wide contracts between trade unions and employer associations. These agreements give trade unions the authority to set the minimum pay and working conditions for employees in specific sectors, for example:
- Retail, Wholesale & Office Staff: These sectors use CCNL Commercio.
- Manufacturing & Technical Employees: CCNL Metalmeccanici.
- Hotel & Restaurant Workers: CCNL Turismo.
There is no statutory minimum wage in Italy, which is why these agreements exist. An individual contract can improve upon these terms, but it cannot offer less. Other elements of employment governed by these agreements include:
- Working hours
- Overtime pay
- Paid leave (holidays and sick leave)
- Notice periods and trial periods
How do I write an Italian employment contract?
To ensure legal compliance, an Italian employment contract must be in writing, specify the CCNL level and include:
- Employer and employee identification
- Job description and employee responsibilities
- Duration of employment
- Length of probationary period
- Details of termination
- Pay and pension fund
- Working hours
- Disciplinary rules
- Severance pay
- Company policies and practices (e.g. use of company equipment)
- Conditions for travel/relocation at the needs of the business
- Compensation duties for employer damages
- Any non-disclosure agreements or fixed terms
Can I make changes to an Italian employment contract?
Yes, but only in certain circumstances. For example:
- If governed by a CCNL, changes must benefit the employee.
- Changes must be mutually signed as an accordo di modifica (modification agreement).
- Duties or job levels can be changed as long as the salary is not reduced.
Do I need to translate an Italian employment contract?
While there is no legal obligation to translate an Italian employment contract into any other language, employers can choose to provide foreign employees with a translation so they fully understand the terms.
