Types of Maltese Employment Contracts
There are two main types of work contracts in Malta – indefinite and fixed-term.
- Indefinite: The most common type of employment contract in Malta, an indefinite contract has no fixed end date. This provides long-term stability, as long as the terms and conditions are upheld by both parties.
- Fixed-Term: Less common in Malta, fixed-term contracts have a set end date as they are often used for temporary or project-based employment.
Collective Bargaining Agreements (Ftehim ta’ Negozjar Kollettiv) in Malta
Alongside these two main types of contracts sit collective bargaining agreements (ftehim ta’ negozjar kollettiv), which trade unions use to secure employee rights beyond the basic statutory minimums defined by the state. This can include better wages, allowances and superior working conditions.
In the private sector in Malta, collective bargaining agreements take place at the company level. Whereas, the public sector usually negotiates common conditions across a range of workplaces.
Under the Employment and Industrial Relations Act, these agreements are made “between an employer, or one or more organisations of employers, and one or more organisations of employees regarding the conditions of employment in accordance with the provisions of any law in force in Malta”.
How do I write a Maltese employment contract?
At a minimum, a Maltese employment contract must include:
- Employer and employee details.
- Job title and description, including the employee’s main duties and responsibilities.
- The employee’s start date (and end date if the contract is fixed-term).
- The length of the probationary period (this usually lasts up to 6 months).
- Details of termination and notice period from both parties.
- Rate of pay and frequency.
- Pension fund.
- Working hours/schedule and leave entitlement.
- Disciplinary rules.
- Severance pay.
- Company policies and practices (e.g. use of company equipment).
- Conditions for travel/relocation at the needs of the business.
- Compensation duties for employer damages.
- Any rules from an associated collective bargaining agreement, if a sector-level agreement applies.
- Any non-disclosure agreements or fixed terms.
Can I make changes to a Maltese employment contract?
Yes. But only with mutual consent – unless the modifications are mandated by national law, collective bargaining agreements or the original contract contains a legally binding flexibility clause. All modified terms must strictly adhere to statutory minimums (or better, if a collective agreement applies).
Do I need to translate a Maltese employment contract?
While there is no legal obligation to translate a Maltese employment contract into any other language, employers can choose to provide foreign employees with a translation so they fully understand the terms.
However, it is important to note that both English and Maltese are official languages in Malta, so employment contracts can still be recognised if they are written in English.
